It is obviously illegal to drive an unroadworthy car on the road regardless of the circumstances. My definition of unroadworthy may well differ from that of the law or the MOT but that is neither here nor there and an argument I am unlikely to win.
The change that has taken place recently is the extra description of failure points as a ‘dangerous defect’ and with it the mandate that the vehicle should not be driven on the road until the dangerous fault(s) have been rectified. A garage should not allow anyone to drive a car away with dangerous faults - this is a new idea Drum - here is the example…
Do not drive until repaired (dangerous defects):
Nearside Front Suspension arm pin or bush likely to become detached Rear bush has become detached from arm (5.3.4 (a) (ii)
This was not going to cause an accident or crash and I was aware of the problem which had not got any worse at least 2 MOTs ago.... and yes despite previous passes I should have done a repair - call it head is the sand.
