In that case definitely pursue Midwest. Their description of the car was misleading, it is still on their website under sold.
Given the level of corrosion that you have found have the front chassis rails been checked?

Yes they have been checked and yes there is corrosion in front chassis legs , was quoted another £600 for that.
This guy is still advertising MX5s ,but strangely when i call he does not answer , i wonder why.
Have you reported him to Trading Standards? They are the people who prosecute under the Consumer Rights Act and I am sure would be interested in the internet description of the car and what you have found. You are not the first to be in this position see the article in this months Practical Classics pages 100 - 102 where they successfully prosecuted a dealer for selling a severely corroded car.
Unfortunately there are some right cowboys out there.
A few days ago I went with a friend to look at a Mk1 S Special at a dealer near Birmingham. Car looked good in photos, all the right questions were asked before we went and the car was advertised as “in great original condition, no rust anywhere”.
What they forgot to say was that the repair on the rear end of the sill was a total bodge. New metal had been put into the outer panel (badly) but they forgot to do the inner panel, there was a large section of it missing where it had corroded away. That’s before I noticed the lower section was just an offcut of metal that was tact welded in place.
The car had been thrown together and was a dog.
Advertised price was £3250!!!
When I pointed out the bodged repair the dealer didn’t really say a lot, only that they all rust in that area!!!
I had a problem with employment law, I was advised to check whether my household insurance included legal expenses cover.
it did, my insurers provided specialist solicitors and barrister. Didn’t cost me a penny.
since then, any time I have had a dispute, I have politely pointed out that I was covered, and the other party has given way.
might be worth a shot.
I don’t now if you have noticed but this guy has convieniently removed the add for this MX5 from his sold gallery after a further email to him this morning.

Obviously feeling threatened.
However even though he may have removed the car from his site you can still find the advert at
http://midwestperformance.co.uk/product/2001mazda-mx-5-1-8-i-2dr/
If you are pursuing him then make sure you have a copy. As I previously said the description clearly does not match the condition of the car.
