No-fault excess

My lovely Miyako was rear-ended by a taxi driver who failed to exchange details back in September.
Now Admiral are telling me that they won’t recover the excess on my behalf, even though they know who he is insured with.
Thiey have given me a phone number for his insurance company and a ref number.
Is this normal,??

I signed up for this, have had no course to use so far so can’t offer actual experience, worth a look though.

Isn’t this what the legal cover is for, that you pay extra for?

My brother went through this. The other side stonewalled to the point where a day in court beckoned. He was asked to submit witness statements as HE was now the claimant, not the insurance company.
It’s been going on since December 2020. I don’t know the latest.
It got hit by a Kirtek van back in 2014. I had a similar experience for 12 months then have heard absolutely nothing since. You will be dealing with about 3 different claims firms.
My worry is that these things fizzle out but stay on your insurance history as an unresolved claim and end up increasing your premiums without you knowing.
I would claim your £1000 for whiplash/headaches/etc and write off the excess.

I didnt read the small print well enough then.
Ive never heard of this before though.
Apparently, they would have acted if it had been over £400 but not for £300.
They would also have repaid my excess if the driver was uninsured, so I would actually have been better off.
They asked lots of questions about whiplash, car hire expenses etc., so they were looking to make money. As there was none to be made, not interested.

I visited my GP within 48 hours (those were the days,eh?) so that it was on record. That way the “whiplash” payout to stop me claiming later was pretty much automatic.

I’m clearly too honest.
I had no whiplash, so I said I had none.
They warn you youre being recorded so no going back on that…

So comprehensive insurance isn’t comprehensive at all

I’m honest too but had a headache for 24 hours.

Fair enough.

This was a very low-speed shunt, so no whiplash.

Still surprised such an obvious no-fault claim ends up with me having to pay the excess.

Don’t Rule Out ‘Whiplash’

Back in 1980 I Had I Slow Speed Prang [Just Reaching for 2nd Gear in a 1.1 Ford Escort Poplar]

Felt a small ‘Twinge’ in my lower back the following day so saw my GP pretty quickly [yep…I Do Remember those Days !] and he said and I Quote

“You’ve Got a Swelling on Your Right Hand Side Where Your Spine Attaches to Your Pelvis…You’ll Have Problems with this in Later Life”

Didn’t Bother with Suing My Employer [Police] as Vehicle was About to Be Written Off through age and was pretty cream crackered

Just Had to Deal with the Micky Taking that ensued from Colleagues and Embarrassment regarding the prang and the Ban from Driving Police Vehicles for a few Months

[Went Down in Police History for the Prang and the Ban]

Anyway…Different Story

GP WAS SPOT ON

Various Probs in This Area since 1980…Worse as Now Shrunk 3 cms in Height

Part of Reason Now Classified as Part Disabled [Pros and Cons]

JUST DON’T BELIEVE YOU MAY NOT HAVE WHIPLASH…HAVE YOURSELF CHECKED ASAP

In My Day You Just ‘Sucked It Up’ …Different Times Now

Interesting.
I had thought of neck problems, which Ive not had.
However my lower back has been troubling me for the last couple of months and sweeping the kitchen flloor with a dustpan and brush yesterday has really aggravated it, so maybe it is related…

I take Ibuprofen immediately I feel a lower back twinge. For me it reduces the time it takes for the pain to wear off from 4/5 days to less than 2 days.

Check you are not allergic to aspirin. It’s in Ibuprofen.

Thanks, yes, took some a couple of hours ago.
Didnt know aspirin was an ingredient but I’m not allergic.
I’ve had little success with Ibuprofen gel but the tablets are really effective

I wouldn’t want to risk him finding out where I live.
He’s not a nice man, no sympathy for my damaged car, plus I reported him to the local authority for failing to exchange details

Failing/refusing to give details is an offence report him to the police, a conviction would put his taxi licence in jeopardy.
Then sue him in the county court, use a solicitor to hide your address and claim his fees as well.
Also tell his insurance company, they don’t like unreported accidents where there is a claim.
Then you will get your NCB back.

Off topic, but that is incorrect and a dangerous statement. Aspirin is NOT included in the Ibuprofen formulary because of the increased risk of side effects (not just allergies).

If you are currently prescribed aspirin to treat an ongoing cardiovascular condition, you should speak to your doctor before taking ibuprofen, not taking advice off a car forum.

Check you are not allergic to ibuprofen because its in ibuprofen.

Off topic but …
Surely it would be dangerous to wrongly advise someone to take a drug, not wrongly advise them to avoid it.
Asparin and Ibuprofen belong to the same class of drugs. My wife is allergic to asparin, has IBD and has been advised to avoid Ibuprofen for the same reasons.
My statement that Ibuprofen contained asparin may have been incorrect - but it was wrong for the right reasons.

Yep !

But Be Aware that Insurers [Apologies Ex Criminal Justice…Me Rusty Knowledge & Training Kicking In]
Are Aware That There Are Folk Who Deliberately Arrange a Shunt in Order to Claim Whiplash !!!
Not Saying This Happened to You & the Taxi
But Insurers Understandably Are Highly Skeptical of Any Prang
I Mean I’ve only Claimed 3 Times since I started driving in 1979 [Twice as a Middle Vehicle in a Pile Up in the 1990s and Once when My Soft Top was Slashed 2019]
All I Did This Year Was Pay a Year in Advance instead of Monthly DD as It Was Cheaper
The DD part of the Org [Left Hand Not Knowing What the Right Hand is Doing] were Straight on to me for cancelling the DD and Threatening Letter for Not Being Insured
Stupid Me then Realized That I’d Forgotten to Tell Them that 3 Months After the Soft Top Was Slashed I’d Managed to Rent a Garage for Bullit and Of Course the Address of the Garage is Different to My Home Address …DOH !
Fortunately…Like You…Honest Person so They Were Cool About My Oversight [Pandemic and All]

Hopefully Insurers Are Well Experienced When Things Don’t Seem to Add Up at Their End ?

Kindest
